Eftpos Systems Limited (“we“, “us“, “our“) respects your privacy and is committed to protecting personal information in accordance with the Privacy Act 2020 (New Zealand). This statement explains what personal information we collect through eftposltd.co.nz, eftpospro.co.nz, and their related subdomains (including hire.eftposltd.co.nz), why we collect it, how we use and store it, and your rights regarding it.

This statement applies to all of our websites and online forms. Where a specific form (such as our merchant application) collects additional information, that is set out separately below.


1. Who we are

Eftpos Systems Limited has been providing EFTPOS terminals and merchant services in New Zealand since 1994. We operate under two brands, eftposltd.co.nz and eftpospro.co.nz, both run by the same company.

2. Information we collect

2.1 General website use

When you browse our websites, we may automatically collect standard technical information such as your IP address, browser type, device type, pages visited, and referring pages, typically through analytics tools (e.g. Google Analytics/Search Console). This is used to understand site usage and improve our websites, and is not used to identify you personally.

2.2 Contact and enquiry forms

If you contact us through a form on our site, we collect the information you provide — typically your name, business name, email address, phone number, and the content of your enquiry — so we can respond to you.

2.3 Short-term equipment hire forms (hire.eftposltd.co.nz / hire.eftpospro.co.nz)

If you book short-term equipment hire, we collect the information needed to verify your identity, arrange delivery, and process payment, which may include:

  • Your name, business name, and contact details
  • Delivery address
  • Identity verification information
  • Bank account details for rental payment/refund purposes

This information is required to fulfil the hire booking; without it, we cannot process your booking.

2.4 Merchant application form (eftposltd.co.nz/apply/)

Applying for a merchant account is subject to Anti-Money Laundering and Countering Financing of Terrorism (AML/CFT) obligations that we, and our banking and payment partners, must comply with under New Zealand law. Because of this, our application form collects more detailed personal information than a typical enquiry form, including, depending on your business structure:

  • Business/applicant details (name, contact details, business structure, NZBN)
  • For sole traders, company shareholders (25%+ ownership), partners, society officers, or trustees: full name, date of birth, identity document type and number (NZ driver licence or passport), and a copy of the identity document (front and back)
  • Proof of address documentation
  • Bank account and proof-of-bank-account documentation for direct debit setup
  • For incorporated societies: certificate of incorporation and latest AGM report
  • For trusts: trust deed and evidence of source of wealth
  • For registered limited partnerships: registration details and the limited partnership agreement
  • An electronic signature, where you complete a direct debit authority through the form

Some of this information is collected indirectly. Where you provide your NZBN, we use the New Zealand Business Number register to automatically retrieve and pre-fill certain business, shareholder, officer, or trustee details already held on that public register, so you don’t have to re-enter them manually. You can review and correct any auto-filled information before submitting.

Why we collect it: This information is required so that we, and the banks and payment processors we work with (see below), can meet our legal AML/CFT customer due diligence obligations and assess and process your merchant application. Providing this information is mandatory for us to process your application — if required information is not provided, we will not be able to complete your onboarding.

Who we share it with: Depending on your application, relevant parts of this information are shared with our banking and payment services partners for the purpose of setting up your merchant account and direct debit authority. This includes, but is not limited to, Cuscal Paymark, BNZ, or your nominated bank. We do not sell your information or share it with third parties for marketing purposes.


3. How we use your information

We use the personal information we collect to:

  • Respond to enquiries and provide customer support
  • Process equipment hire bookings
  • Assess and process merchant applications, including meeting our AML/CFT customer due diligence obligations
  • Set up direct debit authorities with your consent
  • Maintain business records as required by law
  • Improve our websites and services

We do not use your personal information for anything beyond these purposes without your consent, and we do not sell your personal information.


4. Storage and security

We take reasonable steps to protect personal information from loss, misuse, and unauthorised access. Application data (including uploaded identity documents) is held in access-restricted storage while an application is in progress, and is used only by authorised staff for the purposes described above. As with any information transmitted over the internet, we cannot guarantee absolute security, but we take reasonable precautions to protect your information.

We retain personal information only for as long as necessary to fulfil the purposes described in this statement, or as required by law (for example, AML/CFT record-keeping obligations, which require certain customer due diligence records to be retained for a minimum period after the business relationship ends).


5. Your rights

Under the Privacy Act 2020, you have the right to:

  • Ask us to confirm what personal information we hold about you
  • Request access to that information
  • Request correction of any information you believe is inaccurate, incomplete, or out of date

To make a request, contact us using the details in Section 1. We will respond within the timeframes required by the Privacy Act.

If you have a concern about how we have handled your personal information that we haven’t been able to resolve, you can contact the Office of the Privacy Commissioner at privacy.org.nz.


6. Changes to this statement

We may update this Privacy Statement from time to time to reflect changes in our practices or legal obligations. The “Last updated” date at the top of this page will indicate when it was last revised.
